OVERVIEW

This website is operated by Rural Outfitters LLC, trading as Rural Outfitters. Throughout the site, the terms “we,” “us,” and “our” refer to Rural Outfitters LLC. Rural Outfitters offers this website and store, including all related information, content, features, tools, products and services (collectively, the “Services”) to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

The Services are hosted and powered by Shopify, which enables us to provide the Services to you. These Terms of Service (the “Terms”) govern your use of the Services. By visiting or purchasing from our store, using any part of the Services, submitting a review or other User Content, or otherwise interacting with us, you agree to be bound by these Terms and, where applicable, our Privacy Policy, Review Policy, Refund Policy, and other policies expressly incorporated by reference. If you do not agree to these Terms, you may not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, and you provide permission for any minor dependents using the Services on devices you own or control.

You may be required to provide certain information (including email address, billing details, shipping address, and payment information). You agree that all information provided is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or assign your account to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to display accurate images, descriptions, and representations of our products. However, colors or appearances may vary due to device settings and display differences. We do not guarantee that product appearances will meet your expectations.

All product descriptions or pricing are subject to change at any time without notice. We reserve the right to limit product quantities, discontinue products, or restrict sales to any person or geographic region.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. Rural Outfitters may accept or decline your order for any reason. Orders are accepted only when we process your payment and send a confirmation notice.

Please review your order before submitting. We may be unable to cancel an order once it has been accepted and processed. If we modify or refuse an order, we will attempt to notify you using the contact details provided.

All purchases must be for personal or household use and not for commercial resale or export. All purchases are subject to our Refund Policy.

SECTION 4 – PRICES AND BILLING

Prices, promotions, and discounts may change without notice. Prices shown at checkout are the prices in effect at that time. Prices do not include taxes, shipping, customs, or import duties unless expressly stated.

You agree to provide accurate and up-to-date account and payment information. You authorize us and our payment processors to charge your payment method for all charges incurred, including taxes, shipping, and any other applicable fees.

You represent that you are authorized to use the payment method provided and that all charges will be honored by your card issuer.

SECTION 5 – SHIPPING AND DELIVERY

Delivery dates and times are estimates unless expressly stated otherwise. We will take reasonable steps to deliver your order within the timeframe communicated to you, subject to delays caused by carriers, customs, severe weather, supply disruptions, or other circumstances outside our reasonable control.

Where applicable law provides otherwise, those legal rights will apply. In particular, where Rural Outfitters arranges delivery, goods generally remain at our risk until they are delivered into your physical possession or the possession of a person you have identified to receive them.

If you independently commission a carrier that was not offered or arranged by Rural Outfitters, risk may pass to you when the goods are delivered to that carrier, to the extent permitted by applicable law.

Nothing in this section limits any mandatory rights you may have regarding late, lost, damaged, or undelivered goods.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services—including text, images, graphics, logos, videos, audio, product designs, software, and the arrangement thereof—is owned by Rural Outfitters, its licensors, or Shopify and is protected by intellectual property laws. This does not include User Content submitted by customers, ownership of which is addressed separately in Section 11.

We grant you a limited, non-exclusive license to access the Services for personal use only. You may not copy, reproduce, modify, distribute, publish, or create derivative works without our prior written consent.

Rural Outfitters’ and Shopify’s names, logos, and trademarks may not be used without permission.

SECTION 7 – OPTIONAL TOOLS

We may provide access to tools offered by third parties. These tools are provided “as is” and “as available,” without warranties or endorsements. You use optional tools entirely at your own risk and must review the terms applicable to those tools.

Future features or tools added to the Services will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may include links to third-party websites or functionality. We are not responsible for examining or evaluating their content or accuracy. Accessing third-party sites is at your own risk.

We are not liable for any harm or damages related to third-party goods, services, or content. Review third-party policies carefully before engaging in any transactions.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Rural Outfitters is powered by Shopify, which enables us to provide the Services. All purchases are made directly between you and Rural Outfitters. Shopify is not responsible for any sales, products, damages, or losses arising from your transactions with Rural Outfitters. You expressly release Shopify and its affiliates from any claims arising out of your purchases and use of the Services.

SECTION 10 – PRIVACY POLICY

Personal information submitted through the Services, including information submitted in connection with ratings, reviews, photographs, videos, surveys, and other User Content, is governed by our Privacy Policy and, where applicable, Shopify’s privacy terms. Because Shopify hosts the Services, your information may be transmitted to Shopify and third parties located outside your country of residence.

SECTION 11 – REVIEWS, FEEDBACK AND USER-GENERATED CONTENT

You may be able to submit ratings, reviews, comments, photographs, videos, survey responses, suggestions, ideas, and other materials through the Services (collectively, “User Content”).

You retain ownership of any User Content you submit. By submitting User Content to us, you grant Rural Outfitters a non-exclusive, worldwide, royalty-free, transferable, sublicensable, and perpetual licence to host, store, reproduce, display, publish, distribute, adapt, resize, crop, format, and otherwise use that User Content in connection with operating, administering, displaying, and promoting the Services and our products, to the extent permitted by applicable law.

Where additional consent or permission is required by applicable law to use identifiable photographs, videos, or other personal content in standalone advertising or promotional campaigns, we will obtain that permission separately.

You represent and warrant that:

• You own or otherwise have all necessary rights and permissions to submit the User Content and grant us the rights described above;

• Your User Content reflects your genuine experience, where it relates to a product or service;

• Your User Content is accurate to the best of your knowledge and is not deliberately false, misleading, or deceptive;

• Your User Content does not infringe any copyright, trademark, privacy, publicity, or other rights of any person;

• Where your User Content includes identifiable photographs, videos, or information relating to another person, you have the necessary permission to submit that content; and

• Your User Content does not contain unlawful, abusive, defamatory, obscene, fraudulent, threatening, discriminatory, or otherwise prohibited material.

We may moderate, reject, remove, or restrict User Content where we reasonably believe it:

• Is fake, fraudulent, misleading, or submitted in an attempt to manipulate ratings or reviews;

• Does not relate to a genuine experience with the relevant product or service;

• Contains spam, advertising, malicious content, or irrelevant material;

• Contains personal or sensitive information that should not be published;

• Infringes another person's rights;

• Violates applicable law or these Terms; or

• Is otherwise inappropriate for publication for legitimate legal, safety, or technical reasons.

We will not remove or suppress a genuine review solely because it is negative or expresses dissatisfaction with a product or service.

From time to time, Rural Outfitters may offer a reward, discount, or other promotional benefit for including eligible photo content with a product review. Any such benefit is offered specifically for the submission of eligible photo content and is not conditional upon the review being positive, receiving a particular star rating, recommending the product, or expressing any particular opinion.

Where a photograph has been submitted in connection with such a reward, we will display a clear disclosure indicating that the photograph was submitted in connection with a photo reward.

We may use information associated with your purchase or order to determine whether a review relates to a verified purchase and may display a “Verified Purchase” or similar designation where appropriate.

We do not guarantee that every item of User Content submitted will be published or remain available indefinitely. Removal or non-publication decisions will be made in accordance with these Terms, our Review Policy, and applicable law.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

The Services may contain errors or inaccuracies relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct such information and to update or cancel orders when errors occur, even after an order has been submitted.

SECTION 13 – PROHIBITED USES

You may not use the Services:

• For any unlawful purpose

• To violate laws or regulations

• To infringe intellectual property rights

• To harass, insult, harm, or defame others

• To upload malware or harmful code

• To send spam, phishing attempts, or unsolicited messages

• To impersonate others

• To interfere with service security or functionality

• To submit fake, fabricated, deceptive, or misleading reviews or ratings

• To submit a review on behalf of another person while falsely presenting it as your own experience

• To artificially increase, decrease, or otherwise manipulate product ratings or review scores

• To submit multiple reviews for the purpose of manipulating review results

• To offer, request, or accept compensation or other benefits in exchange for a review of a particular rating or sentiment

• To conceal a material relationship, incentive, reward, or other connection where disclosure is required

• To misuse any review, rating, voting, reporting, or verification functionality

We may suspend or terminate your account if you violate any prohibited use.

SECTION 14 – SUSPENSION AND TERMINATION

We may suspend, restrict, or terminate your access to all or part of the Services where we reasonably believe that you have breached these Terms, engaged in fraud or unlawful activity, misused the Services, created a security risk, or where suspension or termination is reasonably necessary to comply with applicable law or protect Rural Outfitters, our customers, or third parties.

Where reasonably practicable and legally permitted, we may provide notice of such action.

Suspension or termination of access does not affect rights or obligations that arose before termination, including rights relating to accepted orders, payments, refunds, statutory consumer rights, intellectual property, User Content, liability, or other provisions that by their nature should survive termination.

SECTION 15 – WARRANTIES AND CONSUMER RIGHTS

We will provide the Services and products with the level of care, quality, and conformity required by applicable law.

Except for warranties, guarantees, conditions, rights, or remedies that cannot lawfully be excluded or limited, the Services are provided on an “as is” and “as available” basis and we do not guarantee that access to the Services will always be uninterrupted, secure, or error-free.

Nothing in these Terms excludes, restricts, or limits any statutory warranty, guarantee, condition, consumer right, or remedy that cannot lawfully be excluded or limited under applicable law.

SECTION 16 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence where applicable, or liability arising from mandatory consumer rights.

Where permitted by applicable law, Rural Outfitters will not be responsible for losses that are not reasonably foreseeable consequences of our breach of these Terms or failure to exercise reasonable care.

Because our products are sold for personal and household use, we are not responsible for business losses, including loss of profits, revenue, business opportunities, goodwill, or commercial interruption, where exclusion of such losses is permitted by applicable law.

Any limitations or exclusions in these Terms apply only to the fullest extent permitted by the laws applicable to you.

SECTION 17 – RESPONSIBILITY FOR MISUSE

To the extent permitted by applicable law, you are responsible for losses, claims, or reasonable costs incurred by Rural Outfitters as a direct result of your intentional or unlawful misuse of the Services, your submission of User Content that infringes the rights of another person, or your material breach of these Terms.

Nothing in this section limits any rights or protections available to you under mandatory consumer law.

SECTION 18 – SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, it shall be enforceable to the fullest extent permitted, and the remainder of the Terms will remain valid.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right does not constitute a waiver. These Terms and related policies constitute the entire agreement between you and Rural Outfitters regarding the Services.

SECTION 20 – ASSIGNMENT

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles.

If you are a consumer, this choice of law does not deprive you of any mandatory protections provided by the laws of the country, state, or jurisdiction in which you habitually reside that cannot lawfully be excluded by agreement.

Nothing in these Terms prevents you from bringing a claim before any court or tribunal available to you under applicable consumer law.

Section headings are for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS OF SERVICE

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal requirements.

Updated Terms will apply prospectively from the date they become effective. Where required by applicable law, we will provide reasonable notice of material changes or obtain your consent.

Changes to these Terms will not retrospectively reduce rights you have in relation to an order or transaction already completed or accepted, except where permitted or required by applicable law.

Your continued use of the Services after updated Terms become effective may constitute acceptance where permitted by applicable law.
